§ 34A-16. Final approval.

  • (a)

    Final approval of the well shall be based on satisfactory completion of the following:

    (1)

    Any person who has drilled, dug, excavated or bored a well subject to this chapter shall, within thirty days after completion of the work, furnish the administrative authority with a copy of the state driller's report. The well driller shall notify the county if submission of the report is to be delayed.

    (2)

    Payment for all costs of related county services shall be submitted to the administrative authority prior to final approval of the well.

    (b)

    No well shall be placed into use until final approval is granted by the administrative authority.

    (c)

    Any newly constructed well that has not been completed or given final approval of the construction within ninety days of the cessation of drilling shall be declared out of service by the administrative authority, and shall be immediately inactivated or properly destroyed by the property owner.
