§ 29-54. Enforcement.

  • Notice of Violation.

    (a)

    Whenever the director of public works finds that a responsible party has violated a prohibition or failed to meet a requirement of this article, the Santa Barbara County public works department may order compliance by written notice of violation to the responsible party. Such notice may require without limitation:

    (1)

    The elimination of illicit connections or discharges;

    (2)

    That violating discharges, practices, or operations shall cease and desist;

    (3)

    The abatement or remediation of storm water pollution or contamination hazards and the restoration of any affected property;

    (4)

    Payment of a fine;

    (5)

    The implementation of source control and/or treatment BMPs; and

    (6)

    The performance of monitoring, analyses, and reporting.

    (b)

    If abatement of a violation and/or restoration of affected property is required, the notice shall set forth a deadline within which such remediation or restoration must be completed. Should the responsible party fail to abate the violation, remediate or restore the affected area within the established deadline, the director of public works may order the work to be completed by a designated governmental agency or a contractor at the expense of the responsible party.

    (c)

    The director of public works may recover all attorneys' fees, court costs and other expenses associated with enforcement of this article, including sampling and monitoring expenses.
