This chapter shall apply to any person who owns, operates or guarantees performance
for or who seeks to own, operate or guarantee performance for any of the following
facilities located in the unincorporated areas of the county of Santa Barbara:
(1)
Any facility involved in exploration, production, processing, storage or transportation
of oil or gas extracted from offshore reserves;
(2)
Any oil refinery; and
(3)
any pier, supply base, marine terminal or staging area within the County's jurisdiction
that supports development of offshore oil and gas reserves.
(b)
This chapter shall not apply to:
(1)
the change of owner, operator or guarantor of the following:
a.
sales gas pipelines operated by a public utility and regulated by the California Public
Utilities Commission;
b.
trucks, railroads;
c.
facilities located in state waters;
(2)
a change of ownership consisting solely of a change in percentage ownership of a facility
and which does not entail addition or removal of an owner or affect any financial
guarantee for a permit.
